Most areas of the website can be accessed without registration, but certain areas are only accessible if you register.

These terms and conditions are binding and may be updated. You should check regularly to review the most current terms and conditions. (or see 2.5)

1. Definitions

‘Contract’ means the contract formed between you and us for the supply of goods by us to you
‘Goods’ means the goods advertised by us on our website and ordered by you
‘Website’ means the website operated by us and located at www.customworks.co.uk
‘You’ means the person submitting an order for goods to us, and ‘your’ and ‘yourself’ shall be construed accordingly
‘Us’ means Customworks, a division of Scotbadge Ltd, (Company Registration No SC173894) trading as Customworks, and ‘we’ and ‘our’ shall be construed accordingly
‘In writing’ includes fax and e-mail

2. Ordering

These terms of sale apply to all goods supplied by us to you, to the exclusion of any other terms except those expressly accepted by us in writing
No contract exists until we have received and accepted your order and sent confirmation in writing – once we do so, there is a binding legal contract between us
OR – you are deemed to have placed an order once having completed the online checkout process. As part of this process, you are given the opportunity to check your order and make any amendments, an order acknowledgement will then be sent to you and at this point there is a binding legal contract between us.
We reserve the right in our sole discretion not to accept your order
The contract is subject to your right of cancellation (see below)
We may change these terms of sale without notice to you in relation to future sales
An order may be refused where:

Goods are unavailable
Authorisation cannot be obtained for your payment
There has been a pricing or product description error
Any of the eligibility criteria set out in the terms and conditions has not been met

3. Description and pricing

All prices exclude VAT (where applicable) at the current rates
The description and price of the goods you order will be as shown on our website at the time you place the order. We cannot guarantee an exact colour match against any photography used on our website as your browser software and monitor may reproduce the colours of the photographs differently from ours.
The goods are subject to availability. If the goods you have ordered are not available from stock, we will inform you as soon as reasonably possible and refund any payment that has been made for the goods.
Every effort is made to ensure that prices shown on our website are accurate at the time you place your order. If an error is found, we will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order. If you cancel, we will refund you for any sum that has been paid by you.
In addition to the price, you will be required to pay a delivery charge for the goods, the appropriate rates are set out in the delivery pricing structure as shown on our website

4. Delivery

The goods will be delivered by recorded delivery mail / courier mail
If there is no-one at the address given who is competent to accept delivery of the goods, the goods will be returned to us by our delivery agents. We will advise you as soon as reasonably possible and shall refund any sum paid by you to us, less our costs incurred in attempting to deliver the goods to you.
Every effort will be made to deliver the goods as soon as reasonably possible, and we aim to despatch within 7 days of our acceptance of your order. However, we will not be liable for any reasonable or unavoidable delay in delivery and will advise you of any such delay as soon as is reasonably possible.

5. Cancellation and returns policy

You have the right to cancel your order at any time up to the end of 7 days after you receive the goods.
To exercise your right of cancellation, you must give notice in writing
If you cancel your order after the goods have been delivered to you, you will be responsible for returning the goods to us at your own cost to the address shown above. You must take reasonable care to ensure that the goods are not damaged in the meantime or in transit.
Once you have notified us that you wish to cancel your order, we will refund you within 7 days for any sum that has been paid by you, less the cost of delivery where applicable. Any returned goods must be received by us unused and in a saleable condition.
If the goods supplied to you are faulty, or if you have any other complaint, you must notify us in writing within 48 hours of receipt. We will not be liable to you in respect of any defect in the goods arising from fair wear and tear, wilful damage, accident or negligence.
For reasons of hygiene, earrings cannot be returned unless proven faulty on receipt

6. Data protection

We will only use the information you provide for the purpose of fulfilling your order. You can request correction or deletion of any information we have about you at any time, this request must be made to us in writing. We would like to notify you of products and offers that may be of interest to you from time to time and if you would like to be notified of these products, please tick the box provided on the website.
Some of the information you provide to us may be given to third parties who act for us for the following purposes:
- Fulfil and deliver orders
- Process credit card payments
- We may also pass aggregate information on the usage of our website, but this will not include information that can be used to identify you
Unless required to do so by law, we will not share, sell, or distribute any of the information you provide to us without your consent
We employ security measures to protect your information from access by unauthorised persons, against unlawful processing and against accidental loss. We will retain your information for a reasonable period or as long as the law requires.

7. Applicable law

These terms and conditions are subject to Scottish Law. Disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the Scottish courts.
